Service availability:

We strive to maintain the service available 24/7, but do not guarantee 100% availability. The service is provided "AS IS" and "AS AVAILABLE" without warranty of any kind.

Scope of Mobile License:

SENSOTED grants you a non-transferable, non-exclusive license to use the MetaDevProfile mobile application on devices you own or control, subject to the terms of the respective app stores (Apple App Store, Google Play Store).

Mobile Application Restrictions:

Mobile License Termination:

This license terminates automatically if you breach these terms. Upon termination, you must cease all use and delete the application from your devices.

Free Trial:

15-day free trial available for Pro subscription.

Subscription Duration:

Monthly subscription: 1 month renewable - Annual subscription: 12 months renewable.

Payment:

Payment processing via RevenueCat, connected to Stripe/Apple/Google.

Renewal:

Subscriptions renew automatically unless cancelled.

Third-Party Responsibility:

You use these external services at your own risk. SENSOTED is not responsible for the availability, content, or performance of third-party services. You agree to comply with the terms of service of each third-party provider.

Service Availability:

External services may not be available in all countries or languages. SENSOTED reserves the right to change, suspend, or discontinue integration with any third-party service without notice.

Institution License Features:

• Institutions can purchase multiple licenses via Stripe payment system
• License distribution and management by institution administrators
• Each license grants one practitioner full access to MetaDevProfile Pro features
• Licenses have defined start and end dates
• Institution owners can assign, transfer, and revoke licenses
• Practitioners receive notifications when licenses are assigned or revoked

License Management:

Institution administrators can invite practitioners, create user accounts with temporary passwords, assign available licenses to practitioners, transfer licenses between practitioners, and revoke access when needed.

License Termination:

When a license is revoked or expires, the practitioner loses access to Pro features but retains access to the free plan. Institution data and patient files remain secure and accessible to authorized personnel.

Monthly subscription:

No commitment, cancellable at any time.

Annual subscription:

15-day right of withdrawal.

Cancellation procedure:

Contact us at legal@metadevprofile.com or use your personal space.

Effective date:

Cancellation takes effect at the end of the current billing period.

User responsibility:

You are responsible for the quality, legality and confidentiality of the data you store on MetaDevProfile.

Data security:

We encrypt all data. Sensitive information is encrypted with AES-256-CBC.

Backup:

While we perform regular backups, we recommend keeping your own backup copies.

Types of Technical Data:

• Device information (model, operating system, version)
• Application usage data and performance metrics
• Error logs and crash reports
• Network connectivity information
• Feature usage statistics
• Session duration and frequency

Consent and Usage:

By using MetaDevProfile, you consent to the collection of technical data. This information is used in aggregate form and does not personally identify you. We use this data to improve service quality, fix bugs, and enhance user experience.

Data Retention:

Technical data is retained for a maximum of 24 months and is automatically deleted thereafter unless required for ongoing service provision or legal compliance.

MetaDevProfile service:

SENSOTED owns all intellectual property rights to MetaDevProfile.

Usage license:

We grant you a non-exclusive and non-transferable license to use MetaDevProfile.

Your data:

You retain all rights to the data you create and store on MetaDevProfile.

Trademark:

MetaDevProfile is a registered trademark of SENSOTED.

Force majeure:

SENSOTED cannot be held responsible in case of force majeure.

Notification:

You will be informed of important changes by email or notification in the application.

Termination by user:

You can terminate your account at any time according to the terms described in the cancellation policy.

Termination by SENSOTED:

We may suspend or terminate your account in case of violation of terms of use.

Data after termination:

Your data will be deleted 30 days after termination, unless otherwise required by law.

Competent jurisdiction:

Any dispute falls under the exclusive jurisdiction of the courts of Aix-en-Provence.

Consumer rights:

This clause does not affect consumer rights.

Export Prohibitions:

Government Use:

MetaDevProfile and related documentation are "Commercial Items" consisting of "Commercial Computer Software" and "Commercial Computer Software Documentation." If acquired by or on behalf of a government entity, these items are licensed with only those rights granted to other end users.

European Union Users:

Other International Users:

For users in other countries, French law applies, but consumer protection laws of your country of residence may also apply where they provide greater protection.
